Terms & Conditions for Tom Lee Music Online Purchase of Products

  1. The customer confirms to accept the terms and conditions of this agreement stated below.
  2. The expression "the Company" below means "Tom Lee Music Co., Ltd.".
  3. The information, photographs, pictures, products, services and other materials contained and/or displayed on the website is for reference only and shall not form part of any offer, contract, representation or warranty expressly or impliedly.

Price and Order

  1. Prices are subject to change without prior notice and all orders are subject to the Company's acceptance at its sole discretion and stock availability.
  2. Prices charged for purchases on Tom Lee Online Shop may be different from those charged in offline stores.
  3. The prices on this website are Hong Kong Dollars.
  4. The prices charged are those applicable on the day you order.
  5. In any event, cancellation, change or refund is not allowed once an order is confirmed.
  6. The Company can cancel the order (and, if applicable, refund the relevant payment to original payment platform), without any compensation under the following circumstances:
    1. Information of the product on this website is obviously erroneous or the product is out of stock
    2. Pricing errors
    3. Website technical problems
    4. The order information is obviously erroneous or the order quantity exceeds the stock
    5. Due to force majeure, transportation delay, system failure or third-party attacks of the website, and other circumstances beyond the control of the Company, the Company finds it necessary to cancel the order
    6. The customer fails to complete payment within the specified time
    7. The Company finds that you used robots, scripts, plug-in software or other technologies to hack our network to purchase products, which may affect the normal purchasing activities or rights and interests of other users, or affect the orderly sale of products. The Company reserve all rights to take necessary legal actions to protect our rights and interests.
  7. All orders are subject to confirmation of final availability and the company reserve the right to decline any order at our sole discretion. In the event that we are unable to fulfill any of the products or services in the Customer's order, we will notify the Customer by phone or email before delivery.
  8. Possible evidence of illegal transaction, e.g. credit card fraud, the Customer should report the loss and record to the Card Issuer. All liabilities subject to the Card Issuer final decision and Tom Lee Music Co. shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

Promo Code, Gift Voucher & Points Earning  

  1. The amount of online purchase will not qualify for any loyalty points of Tom Lee Music Co., Ltd.
  2. Tom Lee Music gift vouchers are not redeemable on the online shop. 
  3. Promo code is only applicable on the Tom Lee Music online shop.
  4. Only one promo code can be used in a single transaction. 
  5. Promo code can be applied once only.
  6. Promo code must be inputted during the designated promotion period.
  7. Tom Lee Music Co., Ltd. reserves the right to change or cancel the promo code without prior notice.

Delivery

  1. For Hong Kong orders, complimentary shipping to the designated residential address for each purchase of HK$1,000 or above. Customers are able to add the designated delivery fee for any order below $1,000 for local residential delivery service. Designated delivery fee will be calculated automatically upon checkout.
  2. For Macau orders, complimentary shipping to the designated residential address for each purchase of HK$5,000 or above. Customers can choose to pick up products in-store at Macau Tom Lee Music for any order below HK$5,000.
  3. After your order has been accepted, the company will confirm with you about the delivery time and date regarding delivery of the item(s) within 3 working days. If payment was delayed due to the bank approval process, delivery date will be adjusted accordingly.
  4. Macau delivery service is available for local districts (including Macau and Taipa) only. Pickup & delivery orders for Macau can be ready in Macau Tom Lee Music within 1 to 3 weeks upon your order date. If the order contains products limited by the Convention on International Trade in Endangered Species (CITES), it will take 3 to 5 weeks time for processing the order. Once we receive the delivery order, we will call you to double confirm the order details first. After the order is ready, we will call you again for arranging the delivery date.
  5. Shipping address as PO Box Number is not acceptable. A deliverable address and telephone numbers are required.
  6. Delivery service is not applicable to areas that cannot be reached directly by our vehicles.
  7. Customers are required to pay an additional charge for delivery to a building without lift service or in cases where goods cannot fit in or be transported by the lift. Such additional delivery fee is to be paid in cash directly to the delivery driver when the items are delivered.
  8. The following applies to all products (not including piano/digital piano/electone):

    1. The following dates are from the customer's date of order or date of availability for delivery, whichever is later. This shall be known as the “deliverable date”.
    2. The goods will be at the customer's own risk upon delivery. Customers must take delivery within 30 days of the deliverable date.
    3. If a customer does not collect the goods within 30 days as aforesaid, the Company may, upon the customer's full payment of the purchase price and upon the customer's request for storage, store the goods up to a maximum period of 6 months from the deliverable date, subject to the customer's advance payment of storage charges.
    4. The monthly storage fee (per unit per month) is 5% of the product value, or HK$1000, whichever is higher.
    5. If a customer does not collect the goods at the end of the 6 month period, the customer is deemed to have abandoned the goods and the Company may, without prior notice, dispose of the goods without any liability to the customer. All payments of the customer are not refundable. In any event, there shall be no refund of the payment made by the customer. The decision of the Company shall be final.
    6. No transaction cancellations are allowed upon purchase. Should there be an exceptional situation that requires a cancellation (and upon being approved by Tom Lee Music), a restocking fee equivalent to 25% of the purchase price or forfeiture of the paid deposit amount (whichever is higher) must be paid. Any cancellation request must be made within the first 30 days from the purchase date.
    7. The Company reserves the right to make adjustment to storage fees without prior notice.

    The following applies to products that are piano/digital piano/electone:

    1. The following dates are from the customer's date of order or date of availability for delivery, whichever is later. This shall be known as the “deliverable date”.
    2. Customers will pay a set deposit amount upon purchase of the piano. Deposit amount will be set by Tom Lee Music.
    3. The goods will be at the customer's own risk upon delivery. Customers must take delivery within 90 days from the deliverable date.
    4. If a customer does not collect the goods within 90 days as aforesaid, the Company may, upon the customer's full payment of the purchase price and upon the customer's request for storage, store the goods up to a maximum period of 12 months from the deliverable date, subject to the customer's advance payment of storage charges.
    5. The monthly storage fee (per unit per month) is 5% of the product value.
    6. If a customer does not collect the goods at the end of the 12 month period, the customer is deemed to have abandoned the goods and the Company may, without prior notice, dispose of the goods without any liability to the customer. All payments of the customer are not refundable. In any event, there shall be no refund of the payment made by the customer. The decision of the Company shall be final.
    7. No transaction cancellations are allowed upon purchase. Should there be an exceptional situation that requires a cancellation (and upon being approved by Tom Lee Music), a restocking fee equivalent to 25% of the purchase price or forfeiture of the paid deposit amount (whichever is higher) must be paid. Any cancellation request must be made within the first 30 days from the purchase date.

  9. If the customer fails to receive the ordered products upon the first delivery appointment, the Company reserves the right to charge an additional delivery fee for subsequent delivery(es).
  10. If the customer requests the company to deliver the goods, the company shall use reasonable efforts to make delivery to the customer, and in such as a case, the company shall not in any way be liable for any loss or damage suffered or sustained by the customer arising from the delivery or failure to deliver or delay in delivery, save and except for gross negligence of the company.
  11. Delivery service may be delayed or suspended on days of bad weather or any other uncontrollable factors. You will be contacted within 24 hours for rescheduling of delivery and such delivery will be made within 7 days thereafter.
  12. Tom Lee Music Co., Ltd. reserves the right to revise any terms of the delivery service from time to time without prior notice. 

Self Pickup in Store

  1. The customer should pick up the goods based on the information stated on the confirmation letter, such as date, time and location. 
  2. The customer cannot change the selected store after order confirmation. 
  3. If the business hours of the selected store is changed due to weather or any other uncontrollable factors, please contact the selected store for business hours confirmation in advance. 
  4. If the selected store is closed due to the weather or any other uncontrollable factors, the customer may pick up the goods in the same store on the next day when the store is opened.
  5. A valid redemption letter is required to be present upon pickup the goods in store. The redemption letter shall be invalid after the expiry date. The redemption letter cannot be exchanged for cash or other goods. 
  6. In the pick up process, staff will send a confirmation SMS to the phone number stated in the online order. The customer has to repeat the SMS verification code and present the credit card which used for purchase goods online for verification.
  7. The customer can pick up the goods at the selected Hong Kong store after 7 working days of the payment is made or when notified, the customer shall finish the pickup process within 14 working days.
  8. The earliest pickup time for Macau pickup order is after 14 working days of the payment is made or when notified. The customer shall finish the pickup process within the designated period of time. Pickup & delivery orders for Macau can be ready in Macau Tom Lee Music within 1 to 3 weeks upon your order date.
  9. If the customer fails to pick up the ordered goods in the designated period, Tom Lee Music Co., Ltd. reserves the right to charge an additional storage fee to the customer. 
  10. If you are unable to collect the goods in person, you may authorize a representative.
  11. The authorized representative must present below documents (Please click here download the template of Authorization Letter)
    1. The Authorization letter (included representative’s name, Hong Kong ID Card first 4 digits and mobile number)
    2. The credit card which used for purchase goods (A copy is also accepted).
  12. The ID card of the authorized representative.
  13. Please note that Tom Lee Music Co., Ltd. may not be able to provide you with the collection service if you fail to provide all information as requested.

Refund and Return

  1. In any events, cancellation, change or refund is not allowed once an order is confirmed.
  2. If there is manufacture defect in the goods sold, customers who enjoyed delivery service may return the goods to specific branch(es) for replacement or exchange within 10 days of the purchase or delivery whichever is the later. While for self pickup in store, customer should contact the specific branch(es) for arrangement. The following terms apply to both conditions:
    1. the Product must not be opened or used;
    2. all parts, accessories, user manual, warranty card (blank), free gifts, redeemed items are intact and returned together with the Product(s);
    3. the original invoice and the credit card used to purchase the Product(s) must be presented;
  3. After investigation, the Company shall arrange exchange for other goods of the same retail price. If the item chosen for exchange is of higher value, the Customer shall pay the price difference at the time of exchange. If the item chosen is of lower value, no refund for the price difference will be provided. Overdue request will not be entertained. The Product must not be opened or used and in good condition.
  4. All refund related logistic and charges shall be responsible by the Customer. The Company shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result (i) the Product must not be opened or used;
  5. In general, there shall be no refund of the purchase price paid. The company will charge 5% of the selling price upon and refund upon Tom Lee Music agreement and before delivery procedures. The refund will take around 14 working day to your card-issuing bank. Please contact your bank to check when the refund will return to your bank account. The decision of the Company shall be final.
  6. In the event the Product returned is not faulty, we may at our discretion decide not to replace or refund you for the Product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your Order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

 

Terms and conditions applied.  In case of dispute, the decision of Tom Lee Music shall be final. 

Terms & Conditions for Purchase of Goods at Branches

  1. The customer confirms to accept the terms and conditions of this agreement stated below.
  2. The expression "The Company" below means "Tom Lee Music Co., Ltd.".
  3. Cheques should be crossed and made payable to "Tom Lee Music Co., Ltd.".
  4. Cheques accepted are subject to final clearing.
  5. The property of the goods shall remain with the Company until payment in full for the goods by the Purchaser.
  6. After the Company has accepted a customer's order and deposit for goods, the customer must pay the balance of the purchase price and take delivery of the goods within 30 days from the date of receipt of the deposit, or if the goods are not in stock on the date of receipt of the deposit, within 30 days from the date of the Company notifying the customer that the goods are available for delivery. If a customer fails to pay the balance of the purchase price or take delivery of the goods, the customer is deemed to have repudiated the purchase contract and the Company is entitled to forfeit the deposit paid.
  7. The goods will be at the customer's own risk upon delivery. Customers are deemed to have taken delivery of goods at the expiry of 30 days as stipulated in paragraph 7 above. If a customer does not collect the goods within 30 days as aforesaid, the Company may, upon the customer's full payment of the purchase price and upon the customer's request for storage, store the goods up to a maximum period of 6 months, subject to the customer's advance payment of storage charges as follows:

  11. If the customer requests the Company to deliver the goods, the Company shall use reasonable efforts to make delivery to the customer, and in such a case, the Company shall not in any way be liable for any loss or damage suffered or sustained by the customer arising from the delivery or failure to deliver or delay in delivery, save and except for gross negligence of the Company.

Refund and Return

Terms & Conditions for Purchase of Piano

The delivery date refers to the purchase date (if the piano model can be delivered immediately) or the stock available date. After the piano is purchased, the company will send a supply notice to the customer and will notify or contact the customer by phone, email, or physical written letter.

  1. Customers need to pay a deposit when purchasing a piano, the deposit amount is arranged as follows:
    1. Piano sales amount: less than 60,000, customers need to pay a deposit of not less than $3,000.
    2. Piano sales amount: 60,000 or more, customers need to pay a deposit of not less than 10% of the selling price.
    3. For transactions involving Steinway & Sons pianos, customers need to pay a deposit of not less than 20% of the selling price.
  2. The full selling price of the piano must be paid before delivery.
  3. If it is necessary to arrange for a site visit due to uncertain space, customers must arrange it within 30 days of the purchase date. If it is determined that the address does not have enough space to place the piano, the full deposit paid (excluding interest) will be refunded.
  4. Customers cannot cancel the transaction after purchase (except for point 3 above). If the customer needs to cancel due to special circumstances, they must apply in writing. After approval by the company, the customer needs to pay an administrative fee equivalent to 20% of the purchase price or forfeit the deposit paid (whichever is higher).
  5. Except for special order pianos, including upright or grand pianos, delivery will be completed within the first 90 days from the day the customer pays the deposit, and the storage fee will be waived in full.
  6. Special order pianos: If the piano purchased by the customer is not in stock and needs to be ordered, it will be counted from the piano arrival date for 90 days.

  8. If the customer fails to complete the piano delivery process within 90 days from the purchase date, they must apply and pay the storage fee (charged from the 91st day).
    1. Monthly storage fee for upright pianos: $1,000 or 1% of the piano sales price (whichever is higher).
    2. Monthly storage fee for grand pianos: $3,000 or 1% of the piano sales price (whichever is higher).
    3. The fee is calculated in Hong Kong dollars, and is calculated as one month even if it is less than one month.
    4. Example: If a U1 customer completes the delivery of an upright piano on the 128th day after paying the deposit, the customer needs to pay a storage fee of $1,000 × 2 months, totaling $2,000.
  9. Within 90 days after the purchase date (except for point 6 above), if the customer has not completed the piano delivery process and has not requested to extend the storage period, the company has the right to cancel the transaction and charge the customer an administrative fee equivalent to 20% of the purchase price or forfeit the deposit paid (whichever is higher).
  10. If the customer needs additional storage time (More than 90 days), the customer needs to apply and pay the full amount first, and pay the piano storage fee according to point 7 above. The company will extend the storage period to a maximum of 12 months/365 days (calculated from the stock available date).
  11. Even if the customer has applied for an extension and paid the storage fee, if the piano delivery process is still not completed after 12 months/365 days from the purchase / stock available date, it will be deemed as canceling the order. The company may dispose of and cancel the order without prior notice, and will not be responsible to the customer. Under any circumstances, the payments made by the customer will not be refunded. The company reserves the final decision-making power regarding the transaction.
  12. Tom Lee Music Company Limited has the right to make any modifications to the above terms and conditions, without prior notice, and reserves the final decision-making power regarding the transaction.

  13. Please find below the additional charges for using stairs or pushing on the road when transporting pianos:

    The delivery charges for instruments that require installation
    If there is a need for additional manpower to carry the instrument up stairs or push it throught difficult between the nearest parking spot and the delivery address, the transportation company may charge an additional fee.

    A1. Road Pushing Fee

    For villages or village houses where vehicles cannot reach, if the walking distance from the unloading point to the delivery address exceeds 100 meters and requires additional manpower to push on the road, the transportation company will charge an extra fee as follows:

The delivery charges for instruments that no need to require installation, If there is no direct elevator access to the delivery address

 

If there is no direct elevator access to the delivery address and additional manpower is required for handling, extra fees will be charged based on the number of floors involved. The fee increases by HK$30 for every 8 levels. Here's an example:

Special Delivery and Store Operation Arrangements for Inclement Weather

In the event that the Hong Kong Observatory announces the suspension of Typhoon Signal No. 8 or above, Black Rainstorm Warning Signal, or Extreme Conditions within the next two hours, delivery services and store operations for that day will be temporarily suspended. If the signal is still in effect at 1:00 PM on a working day, delivery services and store operations for that day will also be halted. No refunds will be provided for orders already placed, and the delivery schedule will be notified separately.

In case of any discrepancy between the Chinese and English versions, the English version shall prevail

Delivery service in Hong Kong is limited to local areas and does not include overseas delivery. The delivery area includes Hong Kong Island, Kowloon, the New Territories, and designated outlying islands: Discovery Bay(*There is an extra charge of $300 for designated areas of Discovery Bay), Ma Wan, and Tung Chung; and does not apply to the following outlying islands: Cheung Chau, Ping Chau, Lantau Island, Mui Wo, Pui O, Cheung Sha, Tong Fuk, Shui Hau, Shek Pik, Po Lin Monastery, Tai O, and any area where trucks are not allowed to enter.
